The exception does not apply to:
- Trees or vegetation located on a heritage item or within a heritage conservation area.
- Trees or vegetation required to be retained under a development consent or Section 88B instrument.
- Trees or vegetation located on land zoned RU1 Primary Production, RU2 Rural Landscape, RU3 Forestry, or RU4 Primary Production Small Lots.
- Land located within the Jerberra Estate.
